CONDITIONS

A)                 The COMPANY agrees to receive, ship and release from Philippine Bureau of Customs and deliver to whomever the SENDER desires, the latter’s personal effects. 

B)                  The SENDER shall take charge of packaging his personal effects.  The COMPANY therefore, shall in no case be held liable for any breakage, damage, spillage or spoilage that may be caused in handling or shipping the same. The COMPANY has provided me (SENDER) with a high quality box designed for optimal loading conditions in the container. I, SENDER, shall not alter the shape of the box in any way.  I, SENDER, will also make sure that the box is properly taped and printed with clear address of sender and consignee. No claims can be made regarding this matter. 

C)                  The SENDER agrees that in the case of loss of said personal effects, the COMPANY shall be liable only for the sum as may be officially declared by the former said liability, however, shall in no case exceed the amount of EUR 100,--. 

D)                 The SENDER shall not send banned or prohibited or regulated drugs, any kinds of firearms, explosives, ammunition, combustible or inflammable materials.  In relation, hereof, the SENDER shall accomplish and complete an official declaration of the contents of said personal property.  In case the SENDER shall make any false declaration and contents thereof be discovered to be banned or prohibited as mentioned above, the COMPANY shall have the right to leave all the SENDER’s personal effects with the Dutch or Philippine Bureau of Customs and/or have the same confiscated by the Dutch or Philippine Government, without the COMPANY incurring any liability against the SENDER, but without prejudice to any case that may be filed against the SENDER or his addressee. 

E)                  I, SENDER, do hereby relinquish in relation to paragraph (D) of the above agreement, any and all of my rights and interest to claim from the COMPANY, for my personal properties which are to be transported by the company, from the Netherlands / Belgium / Germany to the Philippines, should I, SENDER, make a false declaration of any such items in the shipment of my said personal properties. 

F)                  I, SENDER, am aware that a load of 60 kg is the maximum recommended weight per box as included in this agreement. 

G)                  The box(es) will be presented by the SENDER to the COMPANY at the same level as the pick-up car. (e.g. ground floor) and also the box will be delivered by the COMPANY or its forwarding agent at the same level as the delivery car. 

H)                 Payment of agreed shipping cost will be done in cash when the item(s) are picked up. In case of bank transfer, payment must be done within 7 days after pick up. Items will be held in case of delayed payment. 

I)                    This agreement shall take effect upon the signing hereof, and shall cease to exist upon fulfillment of the COMPANY’s delivery of the SENDER’s personal effects to the addressee.
